James Holmes, the suspect in the Aurora, Colo. shooting during the midnight screening of ‘The Dark Knight Rises,’ which left 12 dead and 58 other injured, appeared in court Monday. Here's what went down..

The suspect, wearing a red prison-issue jumpsuit and sporting a shock of orange hair,  was arraigned on the charges stemming from last Friday's shooting massacre.  Holmes , who several times, looked like he couldn't stay awake did not speak to anyone during the proceedings.

During the hearing, the judge informed the suspect that he would likely be charged with first-degree murder. Colorado has the death penalty and a decision on whether or not to seek the death penalty will come down in the next few weeks or so.

The shooter will be kept in custody in solitary confinement for his own safety, as part of a “no bail hold” due to the nature of the crimes of which he stands accused.
