
Lake Charles, Louisiana Man Arrested For Rape After Child Has Baby
LAKE CHARLES, LOUISIANA: Calcasieu Parish Sheriff's Office (CPSO) officials reported that they have arrested a Lake Charles man for rape after a child under 13 gave birth at a local hospital this weekend. We have all the details.
Early Saturday morning (July 27) CPSO Deputies were dispatched out to the local SWLA hospital in response to a call the hospital made claiming they had a minor in their care that just gave birth to a baby.

An arrest serves as proof that there is reasonable suspicion that the subject of the charge was involved in the offense. Until someone is proven guilty beyond a reasonable doubt in court, they are presumed innocent.
Upon arriving to the hospital, Deputies interviewed the minor and she told them that she and Jose L. Montoya, 39, of Lake Charles, have had sexual intercourse numerous times over a two year period.
When CPSO Deputies talked to Montoya he confirmed the information from the minor and said he believes that the baby is his.
After being taken into custody, Montoya was charged with two counts of first-degree rape and taken to the Calcasieu Correctional Center. His bond is still pending.
